What is Trademark Infringement?
Trademark infringement generally occurs when all three of the following requirements are met:1. A company or person uses a trademark owner's trademark (or a similar trademark) without permission.
2. That use is in commerce, meaning it is done in connection with the sale or promotion of goods or services.
3. That use is likely to confuse consumers about the source, endorsement, or affiliation of the goods or services.
The key element of trademark infringement is often the "likelihood of confusion." Several factors determine whether the use of a trademark is likely to cause confusion. For example, if a trademark is used by someone else on unrelated goods or services, that use may not constitute infringement, as it may not lead to confusion. Additionally, which party used the trademark first can be an important consideration.
